Who Is Responsible for Injuries Caused by Gun Malfunctions

Defective Firearms Can Cause Serious Bodily Harm & Create Major Financial Losses

There are a number of things that can go wrong in the process of designing, creating, shipping, selling, and using a firearm. While none of these may be your fault, they could all result in serious bodily injury, even to the point of causing permanent disability or death. Here’s what you need to know.

Common Gun Defects & Malfunctions

There are several very common gun malfunctions you may experience while on the range, hunting, having target practice, or just shooting cans. Every type of gun is susceptible to design or manufacturing error, but older guns have a higher probability of defect. Here are a few dangerous defects you may experience:

  • Failure to extract: Live rounds are not extracted by the firing mechanism but are instead pushed into the un-extracted cartridge, which can cause your gun to blow up, leading to serious burns, scarring, blindness, and a number of other injuries to the face, hands, and skin.
  • Squib load: A bullet gets stuck inside the barrel of the gun and does not discharge from the gun. If a second bullet is fired and hits the bullet stuck inside the gun, the gun can explode.
  • Delayed discharge: After firing the gun, the bullet does not discharge until a few seconds (or minutes) later. Upon subsequent firing, the gun can explode due to accumulated pressure and create serious injuries for the user.

If any of the above have happened to you or someone you love, you are likely aware of the staggering costs and devastating personal consequences that come from gun-related accidents and malfunctions. In order to avoid additional, unnecessary loss or harm, you may need to take action to hold the gun manufacturer, designer, or retailer responsible for the effects (and financial implications) of their negligence.
